The following is David Brands' 1840 will. David was the son of Jacob Brands and Dorothy Fiestler of Knowlton; brother of Jacob and James Brands. His wife was Hannah Harris.
In the name of God, Amen, I David Brands of the township of Knowlton, County of Warren, State of New Jersey, being weak in body but of perfect Sound Mind and Memory, do Constitute and ordain this my last will and testament in way and Manner as follows, that is to say: First, it is my will and order that all my Just debts and funeral Expenses be paid as soon as may be Convenient after my decease. 2nd. I give and bequeath unto my son James Brands the farm I now live on, Commonly Called the homestead farm and ten acres of land that I bought of John Craig, and about ten acres of land I bought of one of the heirs of Mathias Carcuff, dec., that is upland of said lot the fence between the swamp and upland to be the line. 3rd. I give and bequeath to my son [carrat indicating an insertion before John] Brands the swamp of bought of the heirs of Carcuff and the Goodwin lot supposed to be fifteen acres. 4th. It is my will and order that my son James Brands shall pay to my son John Brands the sum of One thousand dollars in one year from the first day of May eighteen Hundred and thirty nine and One thousand dollars two years from the first day of May eighteen hundred and forty. 5th. I give and bequeath unto my son in law James [James is repeated] Hazlett, the husband of my daughter Mary, the sum of one thousand dollars from which amount of One thousand dollars is to be deducated the amount of a Certain Obligation I hold against said James Hazlett, the Ballance to be paid in one year after my decease. 6th. I give and bequeath unto my son in law Sanford Swayze, husband of my daughter Experience, One thousand dollars within One year after my decease ___ Receipt of ___ hundred dollars prior to my ____ Swayze is to be deducted there from. I also give and bequeath unto Charle, my Grandson of Experience Swayze, fifty dollars to be paid to him at the age of Twenty, but in Case he should not survive to that age, it is my will it shall ___ to the ___ of my daughter Experience's Children. 7th. I give and bequeath unto my son Jacob Brands one dollar. 8th. I give to my son David Brands one dollar. 9th. I give and bequath to my son in law William Blair one dollar. 10th. I give and bequeath unto my son in law Daniel Silverthorn one dollar. It is my wish and order further that my daughter Dorothy Silverthorn shall have further use during her natural life the Amount of a Certain mortgage of two hundred and Seventy dollars against Daniel Silverthorn which I hold and at her decease to descend to her Children, share and share alike. _ [Sentence indecipherable, inserted]_. It is my will and order further that if there should be any ____ of my estate at the time of my decease Over and above paying the ____ Specified beyond debts and Funeral Expenses _______ to be Equally divided among my sons and daughters, share and share alike (that is to say) Jacob Brands, Mary Hazlett, Rachel Blair, Dorothy Silverthorn, David Brands, James Brands, John Brands, and Experience Swayze, and if any of my said Children should died before my decease then it is my will that their share of the ____ if any should be be Equally divided amount their heirs, share and share alike.
And lastly, I nominate and appoint my son Jacob Brands and David Brands and Gersham Bartow Executors of this my last will and testament hereby ___ and disannuling all other wills by me before made. In writing thereof I shall herewith set my hand and seal this the thirty first day of May In the year of Our Lord One thousand and eight hundred and thirty nine 1839. Signed, sealed published and declared by the said David Brands to be his last will and testament in the presence of Mathew _______.
